1. Applicability and Company Details

These General Terms and Conditions apply to the use of the website www.epoxy-giethars.nl, all offers made by Epoxy Giethars Shop and all agreements concluded with Epoxy Giethars Shop through the webshop or by other means.

Hereinafter referred to as: Epoxy Giethars Shop.

“Customer” means any natural person or legal entity that enters into an agreement with Epoxy Giethars Shop.

“Consumer” means any natural person acting for purposes outside their trade, business or professional activity.

Consumers are always entitled to their mandatory statutory consumer rights. Nothing in these General Terms and Conditions limits those statutory rights.

The version of the General Terms and Conditions in force at the time the order is placed applies to the relevant agreement.

2. Offers and Product Information

The offers made by Epoxy Giethars Shop are intended for customers in countries to which delivery is available according to the website and the available shipping options.

The available shipping countries may change from time to time.

An offer remains valid for as long as it is displayed on the website and while stocks last, unless stated otherwise.

Epoxy Giethars Shop makes every effort to display product descriptions, images, characteristics, colours, quantities, prices and other product information as accurately as possible.

Images are for illustrative purposes. Minor differences in, for example, colour, packaging, labels or design may occur, provided that the delivered product meets what the customer may reasonably expect under the agreement.

Obvious writing, printing, programming or pricing errors do not bind Epoxy Giethars Shop where it should reasonably have been clear to the customer that an error had occurred.

Epoxy Giethars Shop may change its product range and prices for future orders.

3. Orders and Formation of the Agreement

The customer places an order by completing the ordering process on the website and confirming the order with an obligation to pay.

Before the order is finally placed, the customer is given the opportunity to review the order and the information entered and to correct it where necessary.

After receipt of the order, the customer will receive an order confirmation by e-mail.

The agreement is concluded once the order has been confirmed by Epoxy Giethars Shop.

If an ordered product unexpectedly proves to be unavailable, Epoxy Giethars Shop will contact the customer as soon as possible.

If delivery is definitively not possible, any amount already paid for the unavailable product will be refunded as soon as possible.

Epoxy Giethars Shop may refuse an order where there is a justified reason to do so, for example in the event of:

  • obvious pricing or product errors;

  • insufficient stock;

  • a declined payment;

  • suspected fraud or misuse;

  • legal restrictions;

  • transport-related restrictions concerning the relevant product or delivery address.

If an order is refused after payment has already been made, the relevant amount will be refunded.

4. Prices

All prices displayed to consumers on the website are in euros and include applicable VAT, unless expressly stated otherwise.

Any shipping costs and other additional costs will be clearly displayed before the order is finally placed.

The applicable price is the price displayed at the time the order is placed.

Epoxy Giethars Shop may change prices at any time. Price changes do not affect agreements that have already been concluded.

For orders shipped from the Netherlands to another country within the European Union, the applicable European VAT rules apply.

For deliveries to a country outside the European Union, import duties, local taxes, customs charges or clearance fees may be payable.

Where such costs are not collected by Epoxy Giethars Shop, they are in principle payable by the recipient.

Where legally required, the customer will be informed of possible additional costs before purchase.

5. Payment

The available payment methods are displayed during checkout.

Depending on the options available at the time, payment may include:

  • iDEAL;

  • bank transfer;

  • PayPal;

  • Visa;

  • Mastercard;

  • Klarna, if available;

  • other payment methods offered during checkout.

Epoxy Giethars Shop may make certain payment methods available or unavailable for specific orders or customers, insofar as permitted by law.

Where the customer uses an external payment service provider, such as PayPal or Klarna, the terms and privacy provisions of that payment service provider may also apply.

When using Klarna to pay after delivery, Klarna may carry out an assessment to determine whether the selected payment method is available. Epoxy Giethars Shop has no influence over Klarna's decision as to whether or not a particular payment method is offered to a customer.

Any additional costs associated with a payment method will be clearly displayed before the order is finally placed and will only be charged insofar as legally permitted.

Any payment surcharges will not exceed the amount permitted under applicable law.

In the case of advance payment, the order will in principle be shipped after payment has been received, unless otherwise agreed.

Late Payment by Consumers

If a consumer fails to pay an amount due on time, the consumer will first receive a free payment reminder giving them a period of at least 14 days to make payment.

If payment is still not made after that period, statutory interest and legally permitted extrajudicial collection costs may be charged.

No separate reminder, administration or demand fees will be charged in addition to the costs permitted by law.

6. Retention of Title

Insofar as permitted by law, delivered products remain the property of Epoxy Giethars Shop until the purchase price due under the relevant agreement has been paid in full.

7. Delivery and Shipping

Orders are shipped from the Epoxy Giethars Shop warehouse in the Netherlands.

Shipping may be carried out using, among others:

  • PostNL;

  • DHL;

  • DPD;

  • another suitable carrier.

The carrier used may depend on the destination, weight, dimensions, type of product and available shipping options.

The current shipping options, shipping countries and shipping costs are displayed on the website and/or during checkout.

The customer is responsible for entering the delivery address correctly and completely.

If additional shipping costs arise as a result of a demonstrably incorrect or incomplete delivery address provided by the customer, the actual additional costs incurred may be charged to the customer.

In the case of a consumer purchase, the risk of loss or damage during transport remains in principle with Epoxy Giethars Shop until the consumer, or a third party designated by the consumer who is not the carrier, has received the order.

8. Delivery Time

Epoxy Giethars Shop aims to deliver orders within the period indicated on the website or during the ordering process.

Indicated delivery times are estimates unless a fixed delivery date has expressly been agreed.

If no specific delivery period has been agreed, the order will be delivered within the applicable statutory period.

If delivery does not take place within the agreed or statutory period, the consumer has the statutory rights applicable in that situation.

Where required by law, the consumer will first give Epoxy Giethars Shop a reasonable additional period in which to make delivery.

If delivery is not possible within that additional period, the consumer may terminate the agreement and any amount already paid for the undelivered products will be refunded.

If a fixed delivery date is essential and this has been clearly agreed in advance, the applicable statutory rules will apply.

9. Right of Withdrawal for Consumers

A consumer who purchases a product through the webshop has, in principle, the statutory right to withdraw from the agreement within 14 days without giving any reason.

The withdrawal period begins on the day after:

  • the consumer has received the product; or

  • a third party designated by the consumer, who is not the carrier, has received the product.

Where several products from one order are delivered separately, the withdrawal period begins on the day after the final product has been received.

The consumer may also withdraw from the agreement before receiving the order.

The consumer may notify Epoxy Giethars Shop of the withdrawal, among other ways, by:

The consumer may also use the model withdrawal form and the online withdrawal function made available on the website.

The consumer does not have to provide a reason for the withdrawal.

If the consumer withdraws using the online withdrawal function, the consumer will receive electronic confirmation.

After notifying Epoxy Giethars Shop of the withdrawal, the consumer has a further 14 days to return the products.

The direct costs of returning the products are borne by the consumer, provided that the consumer was clearly informed of this before placing the order.

Use of the original packaging is not required in order to exercise the statutory right of withdrawal.

However, the consumer is requested to package the product carefully and, where reasonably possible, to use the original packaging.

Diminished Value

The consumer may inspect and assess the product to the extent necessary to establish its nature, characteristics and functioning.

If a product is used or handled beyond what is necessary for this purpose and its value is reduced as a result, the consumer may be liable for that reduction in value.

For products such as epoxy resin, UV resin, pigments, silicone, coatings and other chemical products, a reduction in value may occur, among other things, where the product:

  • has actually been used;

  • has been poured out of the packaging;

  • has been mixed with another component or substance;

  • has been contaminated;

  • has been processed;

  • or has otherwise been handled in such a way that it can no longer be sold as new.

Refunds

If the consumer withdraws from the entire order, Epoxy Giethars Shop will refund all payments received for the relevant order, including the cost of the standard delivery option offered.

If the consumer selected a more expensive delivery method than the standard delivery option offered, only the amount corresponding to the standard delivery cost needs to be refunded.

In the case of partial withdrawal from an order, the original shipping costs do not have to be refunded insofar as the original shipping costs would have been the same for the products retained.

The refund will be made no later than 14 days after receipt of the withdrawal notification.

Epoxy Giethars Shop may withhold the refund until the products have been received or until the consumer has provided evidence that the products have been returned, whichever occurs first.

In principle, the refund will be made using the same payment method as that used for the original payment, unless otherwise agreed with the consumer.

10. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply in cases for which the law provides an exception.

This may include, among other things:

  • products manufactured according to the customer's specifications and which are not prefabricated;

  • products that are clearly personalised;

  • products that are liable to deteriorate or expire rapidly;

  • products which, after delivery, become inseparably mixed with other products or substances due to their nature;

  • sealed products which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery, insofar as this statutory exception actually applies to the relevant product;

  • other products or services for which the right of withdrawal is excluded by law.

Merely opening normal packaging containing epoxy resin, UV resin, pigment, silicone or another chemical product does not automatically mean that the statutory right of withdrawal is lost.

However, if a product has been used, mixed, processed or contaminated, depending on the circumstances, a statutory exception or a reduction in value may apply.

The statutory right of withdrawal for consumers does not apply to business customers unless Epoxy Giethars Shop has expressly agreed otherwise.

11. Statutory Warranty and Defects

Consumers are entitled to the statutory warranty.

This means that a delivered product must conform to what the consumer may reasonably expect from the product under the agreement.

In the Netherlands, the statutory warranty does not have a fixed standard period. How long a product should function properly depends, among other things, on:

  • the type of product;

  • the price;

  • the characteristics of the product;

  • the information and assurances provided about the product;

  • what the consumer may reasonably expect from the product.

If a product does not conform to the agreement, the customer should contact Epoxy Giethars Shop as soon as possible.

A notification of a defect by a consumer within two months after discovering the defect will in any event be considered timely.

Where a valid claim is made under the statutory warranty, the consumer is entitled to a remedy free of charge.

Depending on the circumstances, this may include repair or replacement.

If repair or replacement is not possible, is not carried out within a reasonable period, or cannot legally be required of the consumer, other statutory rights may apply, including a price reduction or termination of the agreement.

The statutory warranty does not apply to damage or problems demonstrably caused by circumstances for which the customer is responsible, for example:

  • an incorrect mixing ratio;

  • insufficient or incorrect mixing;

  • processing outside the specified temperature limits;

  • an incorrect layer thickness or pouring depth;

  • processing after the working time has expired;

  • an unsuitable or insufficiently prepared substrate;

  • incorrect storage;

  • adding unsuitable substances or materials;

  • failure to follow product, use or safety instructions;

  • normal wear and tear;

  • damage caused by the customer or a third party.

These provisions do not limit the statutory rights of a consumer where the product did not conform to the agreement at the time of delivery.

12. Use of Epoxy Resin, UV Resin, Chemicals and Other Products

Before using a product, the customer must carefully read and follow the information supplied with the product.

This includes, where applicable:

  • product information;

  • instructions for use;

  • mixing ratios;

  • technical information;

  • safety warnings;

  • product labels;

  • safety data sheets.

Products must only be used for suitable applications and in accordance with the instructions provided.

The final result when processing epoxy resin, UV resin, silicone, pigments, coatings and similar products may be influenced by, among other things:

  • temperature;

  • humidity;

  • mixing ratio;

  • mixing time;

  • layer thickness or pouring depth;

  • working time;

  • substrate;

  • colourants, pigments or other additives used;

  • storage conditions;

  • tools and equipment used.

Epoxy Giethars Shop cannot guarantee a specific processing result where factors outside its control determine the final outcome.

Epoxy Giethars Shop is not liable for damage demonstrably resulting from improper use or failure to comply with clearly provided use and safety instructions, insofar as such a limitation is permitted by law.

This provision does not limit the customer's statutory rights if the supplied product itself is defective or does not conform to the agreement.

13. Transport Restrictions and Chemical Products

Certain chemical products may be subject to statutory transport, safety or import restrictions.

As a result, a particular product may not be capable of being shipped to every country or by every carrier.

If, after an order has been placed, it becomes apparent that a product cannot or may not be shipped to the specified delivery address for legal, safety or transport-related reasons, Epoxy Giethars Shop will contact the customer.

If no suitable delivery option is available, the relevant part of the order will be cancelled and any amount already paid for that part will be refunded.

14. Privacy and Personal Data

Epoxy Giethars Shop processes personal data in accordance with applicable privacy legislation.

More information about which personal data is processed, the purposes for which it is processed, how long the data is retained and the rights customers have can be found in the Privacy Policy on the website.

For the purpose of fulfilling an order, necessary personal data may be shared with service providers involved in the order, such as:

  • payment service providers;

  • carriers;

  • hosting and webshop service providers;

  • administrative service providers;

  • other parties necessary for the performance of the agreement or compliance with legal obligations.

Where the customer chooses an external payment service provider, such as PayPal or Klarna, that service provider may process personal data in accordance with its own privacy terms.

15. Complaints and Customer Service

If the customer has a complaint concerning an order, delivery or product, they may contact:

Where possible, please state the order number and provide a clear description of the problem when making an enquiry or complaint.

For a damaged, incorrect or potentially defective delivered product, photographs may be requested to help assess the issue more quickly.

Epoxy Giethars Shop will handle complaints within a reasonable period and will endeavour to reach an appropriate solution together with the customer.

Consumers' statutory rights remain fully applicable.

16. Force Majeure

Epoxy Giethars Shop is not liable for delays or temporary inability to fulfil its obligations where this is the result of circumstances reasonably beyond its control, insofar as such a limitation is permitted by law.

Such circumstances may include, for example:

  • serious disruptions affecting carriers;

  • natural disasters;

  • fire;

  • war or serious civil unrest;

  • government measures;

  • prolonged failures of essential infrastructure;

  • other exceptional circumstances beyond the reasonable control of Epoxy Giethars Shop.

If a force majeure situation affects an order, the customer will be informed as soon as possible.

This provision does not limit consumers' statutory rights, including any rights arising from failure to deliver.

17. Amendments to the General Terms and Conditions

Epoxy Giethars Shop may amend these General Terms and Conditions for future agreements.

The General Terms and Conditions applicable at the time an order was placed will apply to that order.

A subsequent amendment to the General Terms and Conditions will not have retroactive effect on agreements already concluded unless legally permitted and agreed with the customer.

18. Applicable Law

Agreements with Epoxy Giethars Shop are governed by Dutch law.

Where Epoxy Giethars Shop directs its commercial activities towards consumers residing in another country, this choice of law does not deprive those consumers of the protection of mandatory consumer rules to which they are entitled under applicable international law.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded insofar as such exclusion is legally valid.

19. Disputes

The parties will first attempt to resolve any dispute by mutual consultation.

If this is unsuccessful, the dispute may be submitted to the court having jurisdiction under applicable law.

For consumers, the statutory rules governing the competent court always apply.

20. Final Provision

If any provision of these General Terms and Conditions proves to be wholly or partially invalid, void or unenforceable, the remaining provisions will remain in force insofar as legally possible.

If a provision proves to be invalid, the applicable statutory provision will apply in its place.
