Right of withdrawal

1. Statutory Right of Withdrawal

Are you a consumer and have you purchased a product through our webshop? In principle, you have the statutory right to withdraw from the agreement within 14 days without giving any reason.

The right of withdrawal applies to consumers. A consumer is a natural person acting for purposes outside their trade, business or professional activity.

The statutory right of withdrawal for consumers does not apply to business purchases, unless we have expressly agreed otherwise with you.

2. When Does the Cooling-Off Period Begin?

The statutory cooling-off period is 14 days.

When purchasing a product, the withdrawal period begins on the day after:

you have received the product; or
a third party designated by you, other than the carrier, has received the product.

If your order consists of several products that are delivered separately, the period begins on the day after you receive the final product.

If a product consists of several parts that are delivered separately, the period begins on the day after you receive the final part.

You may also withdraw from the agreement before your order has been delivered.

3. How Do You Exercise Your Right of Withdrawal?

If you wish to exercise your right of withdrawal, you must clearly inform us within the withdrawal period that you wish to withdraw from the agreement.

You do not have to provide a reason.

Use of the model withdrawal form is not mandatory.

If you withdraw using our online withdrawal function, you will receive electronic confirmation of your withdrawal.

It is sufficient for you to send your withdrawal notification before the withdrawal period expires.

4. Returning Products

After informing us that you are exercising your right of withdrawal, you have a further 14 days to return the relevant products to us.

The direct costs of returning the products are your responsibility, unless we have expressly agreed otherwise with you in advance.

We recommend packing the parcel carefully and preferably using a shipping method that allows the shipment to be tracked.

Please keep your proof of shipment until we have fully processed your return and refund.

5. Original Packaging

You are not required to use the original packaging in order to exercise your statutory right of withdrawal.

However, where reasonably possible, we ask you to return the product in its original packaging together with any supplied accessories or parts.

If you no longer have the original packaging, you must ensure that the product is adequately protected to prevent damage during transport.

6. Inspecting and Assessing the Product

During the cooling-off period, you may inspect and assess a product in the same way as you would reasonably be able to do in a physical shop.

You may only handle the product to the extent necessary to establish its nature, characteristics and functioning.

If you use or handle the product beyond what is necessary to assess it and this results in a reduction in value, you are liable for that reduction in value.

We may deduct this reduction in value from the amount refunded to you.

7. Epoxy Resin, UV Resin, Pigments, Silicone and Other Chemical Products

The statutory right of withdrawal for consumers also applies to products such as:

epoxy resin;
hardener;
UV resin;
pigments;
colour pastes;
silicone;
coatings;
oils;
waxes;
polishing products;
other chemical or liquid products

unless a statutory exception applies.

Opening normal packaging does not automatically mean that the right of withdrawal is lost.

However, you must not use the product beyond what is necessary to assess its nature and characteristics.

A reduction in value may occur if, for example, a product:

has actually been used;
has been partially poured out of its packaging;
has been mixed with another component;
has been mixed with pigments, colourants or other substances;
has cured;
has been processed;
has been contaminated;
has been stored incorrectly;
or has otherwise been handled in such a way that the product can no longer be sold as new.

A product that has already been mixed, for example epoxy resin mixed with hardener or another material, can by its nature no longer be separated from those other substances. In such situations, a statutory exception to the right of withdrawal may apply.

8. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply to products and services for which the law provides an exception.

This may include, among other things:

products made specifically according to your specifications and which are not prefabricated;
products that are clearly personalised in nature;
products that are liable to deteriorate or expire rapidly;
products which, after delivery, become inseparably mixed with other products or substances due to their nature;
sealed products which are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery, insofar as this statutory exception actually applies;
other products and services for which the right of withdrawal is excluded by law.

Where a statutory exception to the right of withdrawal applies, we will inform you of this before purchase where required.

9. Refunds

If you withdraw from the entire order, we will refund all payments received from you for the relevant order.

This also includes the original cost of our standard delivery.

If you selected a more expensive delivery method than the standard delivery option offered by us, we are only required to refund the cost of the standard delivery.

If you return only part of your order, the original shipping costs do not have to be refunded.

We will refund you no later than 14 days after we receive your withdrawal notification.

We may withhold the refund until:

we have received the returned products; or
you have provided evidence that you have returned the products,

whichever occurs first.

In principle, we will use the same payment method for the refund that you used for the original order, unless expressly agreed otherwise with you.

We will not charge you any additional fees for the refund.

10. Payment via Klarna

If you paid for your order via Klarna and exercise your right of withdrawal, we will process the return and refund in accordance with the applicable payment procedure.

We also recommend checking your Klarna account or Klarna app and, where available, indicating there that you have registered a return.

The processing of your payment by Klarna is also subject to Klarna's terms and conditions.

Your statutory right of withdrawal against Epoxy Giethars Shop remains unaffected.

11. Received a Damaged, Incorrect or Defective Product

The right of withdrawal is separate from your statutory warranty rights.

Have you:

received a damaged product;
received the wrong product;
received an incomplete order;
or do you suspect that a product is defective?

a brief description of the problem.

Where possible, please include clear photographs showing the issue.

If you make a valid claim under the statutory warranty, the costs of an appropriate legal remedy will not be charged to you.

You therefore do not need to treat a defective product as an ordinary withdrawal.

12. Return Shipping Costs

If you are exercising only your statutory right of withdrawal because you have changed your mind, the direct costs of returning the products are your responsibility.

If we have supplied you with an incorrect, damaged or defective product and you make a valid claim under the statutory warranty, the statutory warranty rules apply and any necessary costs of the legal remedy will not be charged to you.

13. Online Withdrawal Function

For online purchases, you may also use the online withdrawal function on our website during the statutory cooling-off period.

This option is available in addition to the other methods of withdrawing from your purchase, such as by e-mail, letter or by using the model withdrawal form.

You are not required to use the online withdrawal function.

If you withdraw from your purchase using the online withdrawal function, you will receive electronic confirmation recording that your withdrawal was received and when it was received.
